Composer's Own Work

By accepting these terms and conditions during the Track Submission Process the Composer warrants, covenants and represents that the Composition is Composer's original, unpublished work and that no part thereof infringes upon the title or the literary or musical property of any copyright owner, and that prior to submitting the Composition to Sounds of Canada Composer has not sold, assigned, transferred, pledged or mortgaged any right, title or interest in the Composition, the copyright therein, or in any of the rights herein conveyed; that Composer has not made or entered into any other contract or contracts affecting the Composition or any right, title or interest in the Composition, or in the copyright therein, and that no person, firm or corporation other than Composer claims, or has claim on any right, title or interest in or to said work; and that the Composer has all right, power and authority to accept these terms and conditions and make all of the grants, promises and covenants herein contained.

Obligations of Sounds of Canada

Sounds of Canada makes no warranty or other commitment to include any Track or Composition in the Sounds of Canada Music Catalogue, the contents of which is decided at the sole discretion of Sounds of Canada.

Sounds of Canada will endeavour to review all Tracks received via the Track Submission Process and update their Submission Status within a reasonable period but makes no warranty or other commitment except as provided below for "Priority Composers"  that any Track will be reviewed at all, or within any particular timeframe.

Priority Composers

A Composer may purchase from Sounds of Canada a "Priority Composer" status for a period of one year during which time Sounds of Canada will review all Tracks received from the Composer via the Track Submission Process and will update the Submission Status within a definitive period as published from time to time by Sounds of Canada as the "Current Priority Publisher Review Period", not to exceed 30 days from the date the Composition is received by Sounds of Canada.

Listed Compositions

Sounds of Canada makes no warranty that any person will purchase a license for the use of any Composition or Track listed in the Sounds of Canada Music Catalogue.

While Sounds of Canada is actively engaged in the business of the marketing and sales of licenses for the use of Compositions and Tracks listed in the Sounds of Canada Music Catalogue, Sounds of Canada makes no warranty as to the extent of any marketing and/or sales efforts to be performed by Sounds of Canada and reserves the right to cease business operations at any time at the sole discretion of Sounds of Canada without incurring any obligation to Composer except such that might have been incurred during normal business operations in the form of license fees owing to the Composer as the result of licensing sale(s).

By receiving an mp3 file via the Track Submission Process, Sounds of Canada incurs no obligation to Composer or any third party except as expressly provided in duly executed related publishing or agency agreements and under the laws of Canada and the Province of British Columbia.
